FYI, there was a recent court decision that upheld the waiver signed by the plaintiff. Zipline Company Cleared over Waiver — Slaw

"The action of the Plaintiffs was dismissed under a summary trial application under B.C. Rule 9-7 because the release was valid and enforceable and provided a complete defence."

Although, I would still agree with your statement, just thought that some might find this helpful.

We deal with this crap in the ski business every year. The case above now sets a new president for waivers. I do know the ski industry is smiling about the decision.

I think(hope) the judges are getting sick of the b/s.

i just think its funny. say the BIS wasnt happening that weekend. and the same stuff happened. none of this stuff would even be happening..

as far as going after anyone.. its a joke.. this guy is a LOSER!!

if he has sledded before he knows all the risks involved and well like said somehwere here before.. wrong place at the wrong time..

for fawk sakes you can walk acrossed the street and get hit buy a car.. list goes on.i wanna just find this MORON and have some close words with him.

frustrates me to no end. no one is at fault but the person himself.

and thus you can sue the clown driving, what is your point. the point is the guy is looking for cash, and a lawyer has told him he can get him some.

This case was likely created by a lawyer who canvessed numerous people who had thier names in the news trying to stir up and troll enough interest in putting a complaint together.

Taken from a media report last year...

Now this family wishes to come out on top of thier own possible lawsuit.

This Mazzei character is looking to cash in on the loss of another families loved ones. That is enough to disgust me. :nono:

As far as I understand it the avalanche had nothing to do with the BIS event that happened earlier in the day. How can this knob expect to win a non case?
I hope it costs him multiple thousands of dollars in the end.

I feel for the family of the people that passed. Just when they can get there lives back together this comes about.
And for the clubs and volunteers that make Revelstoke the place it is for sledding, they thought this all behind them.

sorry about my comments. i was just telling you how i feel. a TRUE canadian would never try such a thing. this guy is on glue and is very lucky hes alive. others didnt get that option that day. my thoughts are with the familys who have to deal with such fuk ups.

This guy must live in the court houses...

a rolling cluster fawk....hopefully he does not get a dime in a settlement...this would still be a win for him. I'm also hoping his lawyer is charging by the hour (not a % of settlement) so it's an expensive loss.

I'd chip in to help defend if it will make it an expensive loss for him and his lawyer.

This is very sad if this is the way our country is going, I hope this gets punted out of court. Every single person on that mountain was responsible for they're own decisions and actions. It is up to each individual on the mountain to check and adhere to the warnings on avalanche.ca. I cant believe someone could sleep at night knowing they are have filed a lawsuit against the estates of the deceased sledders from the avalanche.

I hope this guy is black balled everywhere he goes. I can't believe this is possable. LOOSER.

Perhaps i should sue the music industry for Lady Gaga or the liqure companies for lost memories and liver damage.

I know the feeling Randy, I have a whole lot to say, but I`m not allowed to. :mad:

Any person or persons that stop or park in an avalanch chute, run out or terrain trap and are injured, buried or killed have no one to blame but themself. Just because someone else is parked there does not make it a safe place to be. if they lived they should look in the mirror, point their finger and call themselves lucky.
this will not go far in our courts I hope.
