Olden days.......? Guys like me still do that vigilante sh*t, F*ck me over and be prepared to have limbs or something broken. Once a guy I worked with owed me money for a car stereo I sold him, he said he'd pay me on our next cheque the following Friday, well when we got our cheque's he also got his walking papers(which I never found out until the following week) After work friday he said Ill bring the money to work on Monday, he never showed, I called him and he wouldn't answer..... for weeks this went on. One day after work I made a visit to his place with a baseball bat and a poolball in a tube sock.Offered him one last chance to pay or give back the stereo and he would not cooperate so....... One busted ass knee from the bat, couple missing teeth and surely some internal bleeding and huge welts from the pool ball. Then walked out to his car while he was down and out, and ripped the whole stereo out (two 12" alpine subs, set of alpine 6x9's, door speakers and an alpine deck) Poor decision on his part. Then 4 years later I seen him at the SAIT bar while I was in school, he bought me a beer and apologized for the whole thing..... said he deserved what he got.... I thought so too

holy sh$%....Tony Soprano

To bring this thread back into the right galaxy here ... I lent a guy quite a few $ thousands this summer when he got laid off suddenly and was going broke. Now he's landed another job making good coin but the repayment term (5 months) he initially committed to is fast approaching deadline and I haven't seen a dime yet.

I can tell from his tone (and past experience) he's going to drag this out because he wants to spend his money on other more fun stuff rather than paying me back. All I have for legally binding documentation is a bill of sale written against a motorcycle, however there is no date on it. There's probably a friggin lien on the bike already I never bothered to check back then.

How do I go about making this more formal? Should I go to a lawyer now to get some kind of document drafted up stating a fixed end date and penalties thereafter? Or do I just approach small claims court once I get fed up enough and take it from there? I don't have any experience with this stuff.

Again the problem is the repayment term was verbal agreement but never written down and signed. Thx for suggestions.

edit PS he's way better at violence than me so threats are not an option

I know you retards have a hard time reading and comprehending but I had it about 6 months, was young then only 18 and thought a stereo would be sweet, quickly realized it wasn't getting its use with me so when someone offered to buy it off me I thought what the hell. And as for the drug habit, not even close on that one but good try. I may be upset if the old man bought a doo but never upset about a cat, and why would that make me mad anyway, Im 27, been on my own for 10 years, Its not like I ride it

Well you can still go full retard and cave his skull in, or hire ole TMO1620 to do it for you, lol. I would love to beat people nearly to death to with bats for things they have done..... but then again I don't feel like living the rest of my then miserable life in the slammer because no way in hell would I get away with it.

However back on planet you are guilty it's a tough call what to do. A lawyer is going to cost some dough but if it's enough money even just a consultation may take you in the right direction. Small claims is never going to work.... because no written documentation of any kind means it never happened, period. I assume you don't have the said motorcycle? If he does, it's yours so take it! That is about the only legal grounds you have to set foot on.

And really, don't ever lend people a dime. I have had "friends" ask for loans in the past and no matter how much I like them it's not happening.

Unfortunately by your story you are in a lose lose situation and just can hope he does pony up the money he owes.

All Small Claims Court does is confirm that someone owes or does not owe you,it is not a means of Collection.

The small amount mentioned, will probably cost a lot to recover.. because even 40% of $700 is $280. What is the Tax benefit of writing off the full amount?

Depending upon the Business you are in...ask for a Retainer or cash equivalent upfront.

Learn from this instance and move on.

I did some work for a customer for about $700.00 and now they won't pay. Have been calling, going to their house, leaving messages etc. for two weeks with no response. They did give me two checks, three weeks ago, one bounced and I never tried to cash the other but did go to their bank today to try verify funds and the checks are written on an account that has been closed. Not sure if it was closed when the checks were written or not.

Anyone else have to deal with the same bullch!t? Not sure which is the best step to take next......

if it's within 45 days of the last day worked you can lien his property. Also, a nasty collection company works as they will contact them at work, home, everything.
