So wait, he could have said no, he didn't want to go back to the police station and he woulda been fine? Odd law they've got there.

I think he has the right to refuse the breathalyzer, just like here. I'm sure he would've been charged and convicted, just like here.

The automatic licence suspensions in Canada are what's stupid, and the fact that the courts uphold that law is unbelievable. And cops charging people with impaired driving when they're not even driving is outrageous.

Tyanna Jackson, 25, was charged in July 2012 after police woke her as she slept in her Pontiac Sunfire in the parking lot of her friend’s apartment building. The youth care worker had been drinking and decided to sleep in her car rather than drive, according to her affidavit filed with the court.
