That's how I read this as well. For the statement to be true, both a) AND b) must be true because it says 'and' not 'or'.

Either way, those who are obviously overloaded deserve the penalties. I think in most situations enforcement is discretionary at least to some extent - even with the larger commercial trucks. There is some forgiveness depending on who you get and your attitude at the time.

I was in a resturant with a buddy and he points at a Ford with a deck on it that had a F250 badge right above the front wheel where you would expect to see it, and he says to me...."What do you see wrong with that truck?" I looked at it and looked at it, and I didn't see anything too strange about it. and he says " Check out the 5 bolt wheels on that F250" The owner, who was hauling a deck, obviously thought he was going to slip under the radar and haul his deck with 2 sleds on it on his 1/2 ton because he had F250 branding on it, and he would be the first one to squawk like hell if he was ticketed. Think the coppers won't notice the difference?? They get paid to see the difference!! And I'll tell you what, they would ticket you to the maximum extent that they could because since you were trying this little scam, you obviously knew better.

LOL LOL actually the truck is a F-250, but under the 7700GVW... I used to have a 1999 F-250 NON super-duty 7700 that had the F250 decals stuck on a half-ton body...All the paperwork and stickers called it a f250 7700... It was fords way of making a heavy half I think..... Quickly got rid of it because it had a 7-bolt pattern, could not find aftermarket wheels

The 7 bolt pattern looks A LOT like the 5 bolt pattern, got to get real close to see, unless it was actually a true f-150 with 5 bolt wheels

ok heres where it gets even better. so your truck has a gvw of 8800. look on your insurance papers. not the door plaque. when your pulled over it goes by insurance papers. if it say 8000 on the insurance papers, thats what they go by. you have to go pay extra to get it bumped up to the full 8800. i know. been through this already!!!

Hey its a good catch, as long as you own a vehicle that is older than 2001 you can overload it as it is written. I did however find another reg that says you can't legally drive on a hiway with it exceeding the gvrw, so one cancels out the other in the eyes of the law. :)


heck I wish guys with trucks would atleast run mud flaps let alone obey the gvrw, geash.


Here I saved this before because they can do the following if they feel its unsafe :

(2) If a peace officer has reasonable and probable grounds to believe that a motor vehicle is not operating under the provisions of an overload permit issued under the Commercial Transport Act and is unsafe for use on a highway because
(a) the motor vehicle is loaded in such manner that the gross weight carried by any of its axles exceeds the gross vehicle weight rating for that axle specified by the vehicle manufacturer, or
(b) the gross weight of the motor vehicle exceeds the gross vehicle weight rating for that vehicle specified by the vehicle manufacturer,
the peace officer may order the owner or operator of the vehicle to do one or both of the following things immediately, or within the time specified in the order:
(c) remove it from the highway until it meets the specifications of the manufacturer referred to in paragraphs (a) and (b);
(d) surrender the vehicle licence or number plates, or both, for that vehicle to the corporation or to the peace officer.

I run 4 mudflaps PLUs 2 more in the middle of truck, hate pitted paint

Might be different in BC but mine says nothing under licenced mass,,thought that applied to commercial registration only

So, with your reply, your saying as long as i pay for the heavier GVW, I can haul that heavier GVW??? In Sk the Insurance papers dont state a GVW... There is a spot for Registered GVW, but it is not used... Maybe it switched once you go COMMERCIAL....

only to max gvw. i went through this with my old 3/4 ton.it was licenced for 8000gvw and if i wanted it to 8800 i had to pay to bump it up. total bs.

yes this was the way it was when I lived in BC as I remember it as well, plus all trucks had commercial plates, is it still that way?

In BC they can class pickup trucks as commercial, but thats why I always wondered for AB for example, my 9200gvw truck is not commercial.
