Anyone ever fight public intoxication ticket?

although eclipse's story sounds pretty legit, thats not quite what happened. What actually happened was that me and some friends had left the local establishment after last call and were on route home, on foot, since i only live 2 blocks away. halfway home i decided it might be humorous to tip over a newspaper stand, so that is what i did. low and behold if there wasn't a popo that had been following us on foot. i thought to my self, heck i can see my building why don't i just make a run for it...... ya that lasted about 2 strides when i went down like a brick ch!t house. The ossiffer lugged me into the hotel, which was right by where this incident happened, since it was -30. Then i got a ticket for intoxication and for "obstructing the roadway".

in the morning i looked at my tickets and realized they were totally illegible since his pen mustve been frozen. well turns out he realized that to and called me to notify he would be sending me new tickets in the mail. so i got them, and mailed them in both saying not guilty. i got court papers for each offence. However, the court paper lists the intoxication offence as happening 8 days later than what is written on the ticket. (most likely because he wrote a new ticket a week later with the old date, but somehow in the paperwork a new date came up)

so not saying i didn't deserve it, just seeing what other people have said to the judge in the past.

I thought I'd be able to outrun them one night after getting caught by spotlight pizzin in an alley... same result, except rather than a fine I got to spend a night in the city lock-up... (in their defense they did try to take me to the brother-inlaws and hand me over to the wife first but I couldn't remember his phone # or address)

If it were me I'd pay the fine and chalk it up to drunken dumb-azzness

Never understood the fascination with knocking over newspaper & mailboxes, karma would expect you to STFU and pay the fine

sorry bud everyone has the right to there day in court, so it is not wasting anyone's time. i say go to court as you have nothing more to lose. and everything to gain. stick it to the man.

I think the whole "wrong date" defense is a myth. The fact that the cop wrote out new tickets and mailed them to you makes me think he might just show up to your court date... then what do you say?
I'm sure the cop will say he seen you leave the bar after closing time and that he could smell alcohol on you. I think the police have some credibility with the courts without the breathalyzer.

Everyone gets their day in court but most people need to just take responsibility for their actions.

Be thankful you didn't get another ticket for trying to run from police, or a bill for the damage to the newspaper stand......shouldn't matter if the date is wrong you clearly deserved the tickets. But atleast you posted a truthful story instead of spinning it to try and just make the cop look like the bad guy. Why do you want to fight them anyway if your guilty and got off easy already?

Don't know the legal definition of public intoxication, but I bet smelling of alcohol and drunk-like actions are enough.

say you were walking home drunk, the alternative is to drive home drunk? "fell" into the newspaper stand on the way home (cus your drunk), you were going to pick it back up but the cop flashed his lights/turned on the spot light you jumped out of the way as you thought a car was going to run into you (cus your drunk).

unless hes a cool/hard ass cop then just pay the ticket, cus he will get you later for more things (tinted windows, missing mud flaps, driving with fog lights on, etc)

i got out of a stunting ticket i was guilty for, but the cop was an a-hole french rookie. i was also moving out of town in a while so i had nothing to lose

nope, wrong date and it can be proven = thrown out, i had a cop write me a ticket on new years eve, he put 1998 instead of 1999......poof gone, also have had a friend get fined for out of date registration, cop for the month on the plate instead of the date issues by accident....gone, it is they're job to have the facts strait on what happened. BUT if the ticket has the right date and the court papers have the wrong one i doubt you'll get off from it.

The clerk lady speaks up and says that that is invalid service and the ticket will be thrown out.... the prosecutor almost agrees then says o wait ill just review the ticket again.... thats when he sees the big write up on it so he reads it to me.. i don't recall doing half those things on there like saying i only had 1 beer, threatening to urinate on the hotel floor, etc etc. needles to say, i changed my plea to guilty, and paid the fine rather than spend one day in jail
