Prim reason to always wear it. You would think that it would be comon sence but seems people think it's more a hassle then it's worth. I'd bet this guy thought that and now not only did he severly hurt his friend but now has huge expenses on his hands that don't include what he wercked on his sled. Sad but hopefully this will serve as a huge reminder to all of us. The 2 seconds it takes to put on and off is well worth the result if we don't.

What if your sled is not manufactured with a tether? If the throttle sticks, is it now manufacture issue. I am certainly not advocating to not wear one, but this opens up for more concern for who is liable.
from this judge if you have tether you better be using it.

Exactly, could have been prevented by not going sledding too.

What if the tether fails?
Should a guy wear two? Redundant tethers.

At the end of the day I am sure the guy didn't mean to hurt his buddy.

It was an accident but he is still liable.
Therefore insurance kicks in.
If he had it.

Maybe the manufacturer gets sued too for not suppling a tether on the sled?

After reading this it is clear that none of you have been through our legal system, I have not either but i had a close friend go through it. The first thing insurance companies look for is did this guy follow all the rules? The court system is the same did you leave yourself vulnerable? The tether in this case was the root cause, it is a safety device that was not being used and designed to prevent exactly what happened. The only reason the tether is highlighted is that is what Skidoo uses now if it was an AC, Yamaha or Polaris the throttle safety switch would have been the focus. Now if the TSS is disconnected or altered in any way you are still guilty, if you disconnected the TSS and replaced it with a tether you are still guilty. Adding a tether to a functioning TSS most likely would be your only safe move. These cases don't come to light often as you never hear about small amounts of monies, this case is most likely in the millions. Most likely had this individual had insurance they still would not have covered him due to negligence. I am not a lawyer but do know what my friend went through and it was totally unbelievable and still makes me sick to my stomach when i think about it. We have a legal system and if you end up in it you need very deep pockets and a strong stomach.
