it depends on why they backed out.

if they were unable to supply the unit due to their allocation of sleds from the manufacturer, then there is nothing you can do.

if they decided that it was not in their best interest to sell you the sled because they could get more money else where, then i would have a problem. any reputable retailer, cars, boats, sleds, whatever should have supplied you with a work sheet, and hopefully a bill of sale. this entitles you legally to what you agreed to purchase. sounds like you are living up to your end of their agreed to bargin.....what happend??

there is amvic, which is alberta motor vehicle industry council, they are the mediators between car dealerships and consumers when there is a dispute, phone them up. they might be able to help you with the legalities of the bill of sale. welcome to AMVIC Committed to providing a fair marketplace for both Consumers and Businesses

I was trading in my 08 M1000 snow pro on a Assault, they felt they needed more money difference, i believe its because of the demand for these sleds and they still have an 08m on the ground.

Do you have signed paperwork showing the agreed upon price difference? If it was word of mouth then you are SOL. I bet there scared of the trade. The economy is not what it was when you ordered the sled, and money is getting tight.

They also told me they had 15 people wanting one, and they only ordered 9 and the nine they ordered are snowchecks! He then proceeded to tell me the new blue book price was quite abit less than it was at snowcheck time! Is that my problem, is`nt this why we have snowcheck !

When you snow checked, did you get a price on the Assault and a written guaranteed Oct 08 trade value for your 08M?

If so, you are very smart snow checker and you would have any reputable dealer cornered to the deal.

If not, then you will have to take their current offered difference or buy the unit outright and sell your M privately or leave the deal.

Lower 09 Cat prices have driven down trade values lower than blue book this season and it is easy to see why a larger difference may be being requested than an estimate provided back in April.

Yes it is your problem if you did not get a guaranteed value for your trade in October 2008. No intelligent dealer would give a guaranteed value in April for a machine that is coming in October unless they low balled the value from the get go.

Snowcheck is there to guarantee you the delivery of your chosen sled from a given manufacturer. Snowcheck does not guarantee you the value of your trade.

The Assault is attached to your name by Polaris. Your Assault is waiting to be registered to you. Cut a deal or cut out.

So if i bought stocks at a set price and then the stocks rose, am i suppost to pay the differance even though i already own them?

I think there is something your not getting here.........We made a deal, the cash difference with the trade....done deal right.... they called me to come and pick up my sled......contract missing from folder.....new deal 500 more than at snowcheck....i called B.S....they told me to ride my old sled for another year......

Well my man i say wrong... If they are a reputible place they know when they are getting the sled and when your new one will come in and they should price things accordingly.. So for them to back out now is wrong... I'd call polaris customer service and complain.. That is complete bad business practice on the dealerships part... this is my opinionm and 2cents... I worked at a couple dealerships in the pasts 20yrs..

Do you have the m1 at home now or did you give it to the dealer when you snowchecked , I know when I was looking to trade my 07 when I snow checked my 09 the dealer wanted the 07 at the dealer so he could sell it, and the trade in price was taken off the price of the 09 bill of sale, I thought it was kind of strange, but I managed to sell the 07 privately. Umm If you didn't get a bill of sale than the dealer can do this because the sled depreciated over the 6 months, A 08 M1 you won't have trouble selling that! if you can do it buy the assault or ask the dealer to hold it until you sell the M1, just out of curiousity was it a big price difference?

Well this sounds shady to me it's too bad you didn't have a copy of the bill of sale this would be hard to prove.

:confused: didn't I just read this on BLOWWEST?...No paperwork and No charge on your Visa if I remember the post? GOT CH!T out of LUCK but I would call headquarters and make a complaint anyway...GOOD LUCK...:beer:

Actually this reminds me of another polaris dealer story, that a friend told me. He went to pick up his new sled and was told polaris had taken away the rebates that was offered in the spring, he told them to go pound sand and bought a doo.

OK...so new information...you had a contract with the dealership. This is what I was asking...did you have written agreement? Your answer: Yes.

Great! They lost their copy...that's ok...you pull out your copy.

You do have your copy....right?

It is really fishy though for them to "lose their copy".
