Bogus photo radar ticket

Buddy got a ticket where his truck is photo'd in an 80 zone and he is doing 75 but the ticket says zone is 60, so he is 5 under they say he is 15 over. The photo clearly shows him a few hundred feet past the speed sign that says 80 not the previous 60 zone. Anyone fight one of these? And does the photo have to be in the 60 zone or can they say he was radar'd in the 60 but we snapped the photo once he was past the 80 sign? I'm thinking he should fight it, my opinion is truck needs to be in the 60 zone IN the photo.

I agree. I'd fight it if the picture clearly shows the truck past the sign. As they say a picture is worth a thousand words. And the proof is in the picture. Jm2c

Doesn't matter that he's past the sign.... The photo radar unit clocks you before you pass it... The pic is just to get your plate #.
So he would have been clocked before he got past that 80 sign.

It's what a $130 ticket? If he fights it it's a day off work then he out the days wage! And I am guessing it's more then the ticket.

Go to the court house when the crown is in. Usually Mondays. Call the court house and find out first. Go in and show him/her the ticket. It'll either get tossed or reduced.

at most court houses there is a hearings officer, and this can be handled by them, without going into court to fight the ticket.... they are quite reasonable and I fought and won a ticket that way... the photo was taken too closely to the next speed sign.... was a 60kph zone and I was accelerating to the next sign that was 80kph.... I too was clocked at 75kph, because I was accelerating up to the 80kph. the photo radar never should have been placed that closely to the change in speed area, and the hearings officer agreed.... said they had several complaints come in, in the previous weeks, and they said there would probably be several more. It is unrealistic for them to expect a driver not to accerate up to the speed previous, because you can see the sign a 50 yards before or so...

I'd fight the ticket ;)

I would fight the ticket, they will likely at least reduce the fine if not throw it out. And as stated above it will take a visit to the court house, but it should not be an all day affair. I have had a couple tickets reduced this way

So, just bend over and accept it??? wtf?? The photo radar operator should not be setting up in a speed transition zone...PERIOD!

If he does not speak up and fight this the bullsht will continue....

My understanding is they are also not supposed to break the law in terms of where they park....ie setting up in noparking zones, parking on blvds, parking on the wrong side of the street....could be wrong but I thought traffic laws cannot be broken unless their emergency lights are activated

Agree with above posts ......... always fight the ticket it will get reduced every time at the very least.

odd they threw it out, but good on ya. you aren't supposed to accelerate in anticipation of a higher speed zone, you are legally supposed to wait until you get to the sign. what if it was a school zone? should one speed up while still inside the school zone because you can see the sign ahead? food for thought....

looking at it from the other side...you are responsible for ensuring you are at the slower listed speed when you pass by the sign (100 zone changing to an 80 zone) meaning you must transition down from 100 km to 80 km BEFORE you cross the line. It would be seen by the judge that this transition zone works for acceleration also. This is why you don't see a faster speed limit until you are well out of the area such as a school zone or a highway passing through or near a town....

Trust me I tried fighting a ticket cause I was caught doing 75 in a 50 but was speeding up to go through the 80 zone. Your supposed to to 50 until you go past the 80 sign then speed up! That's the law I didn't get off on the ticket cause of that. The transition zone is after the sign not before it!

you are incorrect, there is no "transition zone" except for coming into a lower speed zone where there is usually a sign with an arrow telling you it is a lower speed ahead. you cannot legally speed up before you hit a sign telling you the speed is higher.
